07.01.2022 tkm/ct 29 C.R.M. 8915 of 2021 sl no. 35 (via video conference) In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Kotulpur P.S case no.199/2021 dated 11.8.2021 under sections 302/34 of the IPC And In Re : Raju Malik & Anr.
........ petitioners Mr. S Mandal Mr. A Dan ...... for the petitioners Mr. N Ahmed Ms. Trina Mitra ...... for the State Petitioner no. 1 is in custody for 145 days and petitioner no. 2 is in custody for 143 days. It is submitted that they have been falsely implicated in the instant case.
Learned lawyer for the State opposes the prayer for bail. We have considered materials on record. Statements of witnesses show that the victim had been abducted by the petitioners and thereafter murdered.
In view of the gravity of the offence and the materials on record, we are of the opinion this not a fit case to grant bail to the petitioners.
Accordingly, the prayer for bail is rejected. (Bibhas Ranjan De, J.) (Joymalya Bagchi, J.)
