Learned advocate appearing for the petitioners submits that the petitioners along with another were implicated in connection with the instant case for recovery of 200 bottles of phensedyl. Petitioners are in custody for 11 months and there is hardly any scope of the trial being completed as charge has only been framed on 18th September, 2025.
Learned advocate appearing for the State opposes the prayer for bail and submits that he has no instructions regarding the charges having been framed and there are materials available in the case diary against the present petitioners. Be that as it may, in case the charges have been framed by the learned trial court, the petitioners be released on bail. Accordingly, the prayer for bail of the petitioners is allowed. The petitioners namely, Sarif Sk. and Rintu Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees
Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned special court.
Accordingly, CRM (NDPS) 1074 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
