Abdul Kuddus -Vs.- The State of West Bengal Mr. Arijit Ganguly Ms. Sujata Das .....For the State The present revisional application was preferred challenging the order dated 13.11.1998 passed by the Learned Additional Sessions Judge, Birbhum, Suri in Criminal Misc. Case No.729 of 1998 arising out of Rajnagar Police Station Case No.20 dated 03.10.1998 under Section 420/ 376 of the Indian Penal Code. As none appeared on behalf of the State, Mr. Arijit Ganguly, learned advocate who ordinarily represents on behalf of the State is directed to represent the case. His appointment may be regularized by the concerned authority. The subject-matter of the present revisional application related to the order dated 13.11.
1998 wherein a second application for anticipatory bail was rejected by the Learned Additional Sessions Judge, 3rd Court, Birbhum, Suri. Having regard to the subject-matter and contents of the order dated 13.11.1998, I am of the opinion that the jurisdiction of this Court under Section 401 read with Section 482 of the Code of Criminal Procedure cannot be invoked in respect of the impugned order. Records also reflect that the revisional application is yet to be admitted. There has been complete change of circumstances as almost 23 years have already passed.
According, C.R.R. 2774 of 1998 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
