His appearance may be regularised by the concerned authority.

The grievance of the petitioner is as follows. Without recovery of streedhan articles, charge-sheet was submitted against her before the jurisdictional court on June 12, 2023. This fact was brought to the notice of the learned ACJM, Basirhat wherein the learned court called for a report from the investigating officer on June 26, 2023, and subsequently, charge-sheet was submitted. The petitioner has not been granted any opportunity to raise her grievance in respect of the charge-sheet submitted.

Having considered the legal aspects that the complainant is entitled to have an audience at this stage when she has grievance relating to the nature of investigation being conducted, I direct that once the petitioner prefers an application under section 173(8) CrPC before the learned ACJM, Basirhat or the jurisdictional court, the learned court would, in turn, after issuance notice, dispose of the same in accordance with law, within a period of 60 days from filing of the application.

With the above observations, CRR No.3102 of 2023 stands disposed of.

Pending application, if any, stands also disposed of. Parties are to act on the server copy of this order duly downloaded from the official website of this court. Certified copy of this order, if applied for, shall be made available to the parties.
