For the State Mr. Animesh Das ...for the respondent nos. 5 to 8 The writ petitioner complains that Liluah Police Station has not taken steps in respect of a complaint of disturbance by the private respondents. The petitioner has admittedly obtained a decree in T.S. No. 96 of 2010 from the Court of the learned Civil Judge (Jr. Division), Howrah.

A first appeal from the decree has been dismissed and a second appeal is pending before this Court. There is no stay of the decree till date. The petitioner is therefore entitled in law to seek execution of the decree-in-question.

The Liluah police shall, however, ensure that there is absolutely no breach of peace in the area. With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.
