The grievance raised in this petition is that violating the Ancient Monuments and Archaeological Sites and Remains Act, 1958 the respondent no. 9 is raising a pucca multistoried building within 60 metres of the Beth-El-Synagogue monument which is prohibited in law.
When the matter is taken up today, learned counsel for the petitioner has raised a limited submission that the representation dated 03.12.2021, annexure P-4, has been submitted before the respondent no.5, therefore a direction be issued to the said respondent to consider and decide the said representation.
Having regard to the issue raised in the petition, we accept the prayer and dispose of the present petition with a direction to the respondent no.5 to duly consider the petitioner's representation dated 03.12.2021 and take an appropriate decision in accordance with law as
expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. (Prakash Shrivastava, C.J.) (Rajarshi Bharadwaj, J.)
