Petitioner is aggrieved by the fact that the promoter took a sum of Rs. 5,00,000/- for flat of 300 square feet. Neither the property was handed over nor the money was refunded. To that effect, representation was made on or about 25.07.2023. Learned advocate submits that the respondent no. 4 expressed to enter into a settlement and by way of allurement, handed over a sum of Rs. 2,00,000/-, but did not hand over the rest of the money.

Having considered the same that the present case is for recovery of rest of the money, I direct that the petitioner would invoke the jurisdiction of the civil court or the criminal court having domain over Shibpur Police Station.

In case any application is filed considering the age, incapacity of the petitioner, the concerned courts will take steps in accordance with law. With the aforesaid observations WPA 20113 of 2023 is disposed of.
