Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Avishek Sinha, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner was arrested on 15.08.2022 and chargesheet has been submitted in connection with the said case on 31.08.2022. Learned advocate submits the petitioner is in custody for more than one year and till date, charge has not been framed by the learned Additional District and Sessions Judge, Fast Track Court No.1, Basirhat, North 24-Parganas. It reflects from the records that the next date has been fixed on 04.10.2023. I direct the learned trial court to consider the stage of framing of charges on the next date so fixed and complete the process of framing of charges/consideration of charges by 18.10.2023. On and from the month of December 2023, the learned trial court would fix a schedule consisting of three dates and try to fix such schedule once in a month so that trial of the case can be concluded within a reasonable period of time. No

unnecessary adjournment should be granted to either of the parties.

In case any witness is absent on the date so fixed, the learned trial court would communicate with the Superintendent of Police of the concerned district for ensuring the presence of the witnesses.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

It is directed that in this case in spite of any resolution of the Bar, the trial of the case from the next date onwards should proceed before the court.

All stakeholders are directed to cooperate with the learned trial court to conclude the trial at the earliest. With the aforesaid observations, the revisional application being CRR 3106 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
