Mr. Bhaskar Chadra Manns Ms. Moumita Biswas ....for the petitioner Mr. Mohit Gupta Mr. Debashish Basak ....for the respondent nos.1-4 The petitioner alleges that the plots of land of the petitioner has been utilised for a railway project but compensation in respect thereof has not yet been paid. The petitioner further alleges that the petitioner is also entitled to employment under the relevant scheme. The petitioner claims to have submitted a representation before the Senior Divisional Personnel Officer, South Eastern Railway, Kharagpur by a letter dated May 6, 2025.
Mr. Manna, learned advocate appearing for the petitioner submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioner till date. The learned advocate representing the railway authorities submits that the petitioner has not furnished any documents in support of the claim to the railway authority for which the authority could process the claim of the petitioner for payment of compensation as well as employment.
Since a representation has been submitted by the petitioner before the respondent authority, this Court feels that the interest of justice would be sub-served if such authority is directed to consider the representation of the petitioner and dispose of the same within a specified time limit.
In the light of the submission made by the learned advocate for the respective parties, WPA 20120 of 2025 stands disposed of by directing the Senior Divisional Personnel Officer, South Eastern Railway, Kharagpur, being the respondent no.2 to consider the representation of the petitioner dated May 6, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representatives and communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed as expeditiously as possible but positively within a period of 10 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated May 6, 2025.
It will be open to the respondent no.2 to call upon the petitioner to produce the documents in support of the claim of the petitioner for payment of compensation as well as employment.
If such request is made, the petitioner shall be obliged to furnish documents to enable the respondent authority to dispose of the said representation.
It will also be open to the respondent no.2 to afford an opportunity to any other affected person whose presence may be necessary for the purpose of adjudicating the claim of the petitioner.
There will be no order as to costs.
