1. Ms. Parna Roy Choudhury, learned counsel for the appellants and Mr. Indranath Mitra, learned counsel for the respondents are heard.

2. CAN 1 of 2024 is an application filed under Section of the Limitation Act seeking condonation of delay. Since during the course of hearing, learned counsel appearing for the parties reached to consensus for disposal of the matter with certain directions and no objection was raised to the application for condonation of delay, the delay is condoned. Thus, CAN 1 of 2024 is allowed.

3. The parties reached to consensus that this matter may be disposed of by modifying the order of learned Single Judge dated 16.10.2023 by directing that the direction so issued by the learned Single Judge shall be applicable to the Labour Department and Finance Department with full force. The time limit granted by the learned Single Judge shall start from today.

4. In view of consensus arrived at, this matter is disposed of directing the Labour Department and Finance Department of the State to comply with the order of the learned Single Judge within the stipulated time. The time limit shall start from today.

5. Accordingly, the appeal being MAT 1605 of 2024 is disposed of without expressing any opinion on the merits of the case.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
