The petitioner complains that the private respondents who are co-sharers in the property, have blocked his entrance after filing a civil suit. Admittedly TS No.91 of 2021 is now pending before the learned Civil Judge (Senior Division) at Contai, Purba Medinipur in respect of the property in question.

The private respondents deny having obstructed the petitioner's entry and exit.

Learned counsel for the State has filed a report in the form of instructions dated 14th September, 2022 issued by the Officer-in-Charge, Patashpur Police Station addressed to the learned Government Pleader and the same is taken on record.

It appears from the report that on the petitioner's complaint FIR being Patashpur Police Station Case No.518/22 dated 13th September, 2022 has been registered.

Let the investigation into the aforesaid FIR be completed as expeditiously as possible.

The dispute between the parties is civil in nature. The petitioner may seek remedies either in the pending civil suit or in any other civil proceedings in accordance with law.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
