1. This contempt application has been filed alleging willful disobedience of the order and direction dated 11th July, 2024 in W.P.A.(P) 257 of 2024.

2. Upon notice, the Pradhan of the Gram Panchayat is represented by a counsel and a copy of the inspection report dated 22nd January, 2025 has been placed before this Court from which it is seen that the factory, which was established by the private respondent no.4 in the contempt petition i.e. the respondent no.9 in the writ petition has been closed and there is no manufacturing activity in the factory. However, the machinaries have not been dismantled. As long as the factory is closed, the applicants cannot have any grievance.

3. However, while disposing of this contempt application, we direct that the authorities, more particularly, the Sub-Divisional Officer, Jangipur, viz. the respondent no.1 herein and the respondent no.4 in the writ petition

shall ensure that the factory is not commenced by the private respondent no.4 in the contempt petition i.e. the respondent no.9 in the writ petition.

4. With the above observation, contempt application stands disposed of.

5. No costs.

6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
