Learned counsel for the petitioner contends that despite having applied for a new electricity connection and complied with all formalities, the CESC Limited has not yet been able to give such connection due to resistance created by respondent no. 4, another tenant at the premises.

Affidavit-of-service filed in Court today be kept on record.

Despite service, none appears for the private respondent no. 4.

Learned counsel appearing for the CESC Limited submits that the Distribution Licensee has no issues in giving such connection to the petitioner otherwise than the obstruction created

by respondent no. 4, since the petitioner has complied with necessary formalities.

In such view of the matter, since the private respondent no. 4 chooses to abstain from hearing the matter, the matter is being heard and disposed of in the absence of the private respondent no. 4.

Hence, WPA No. 20494 of 2022 is disposed of by directing the CESC Limited to give new electricity connection to the petitioner pursuant to the petitioner's application within a week from date.

In the event any resistance is put up by the private respondent no. 4 and/or his men and agents and/or any padlock is affixed to prevent the access of the CESC Limited personnel to the existing meter board location for giving such new electricity connection, the CESC Limited personnel will be at liberty to approach the respondent no. 3, the Officer-in-Charge of South Port Police Station, for adequate police assistance.

If so approached, the respondent no. 3 shall act on the server copy of this order, coupled with the communication of the learned Advocate appearing for the petitioner, for giving such

assistance to the CESC Limited personnel at the cost of the petitioner and/or to remove any hindrance or padlock, if so affixed, to resist the CESC Limited personnel from reaching the location of the existing meter board position for such purpose.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
