Learned Counsel for the petitioners submits their names do not feature in any of statements of the witnesses recorded under Section 161 of the Code of Criminal Procedure. They pray for quashing of the proceeding.

We have considered the materials on record. It is alleged the deceased had entered Jarur village to commit theft. Villagers assaulted him resulting in his death. Petitioners are not named in the FIR. It is contended that witnesses did not name them as assailants.

Uncontroverted allegations disclose ingredients of the offence. However, it is open to the petitioners to agitate these issues before the learned Judge at the appropriate stage of the proceeding including consideration of charge in accordance with law.

With this observation, the revisional application is disposed of.
