22.08.2023 tkm/ct 28 C.R.M. (DB) 3285 of 2023 sl no. 38 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Bandel GRPS Case No. 30 of 2019 dated 29.6.2019 under sections 302/120B/34/201 IPC and In Re : Mangal Yadav ........ petitioner Mr. S Biswas ...... for the petitioner Mr. M Sur Mr. D Paramanick ...... for the State 1.
Petitioner is in custody for almost four years. He renews his bail prayer.
2.
Learned Public Prosecutor submits 29 witnesses have been examined. There are materials to show petitioner along with his family members had conspired to commit the murder. 3.
We have considered the materials on record. Bail prayer of the petitioner was rejected earlier on merits. Delay in the matter was due to vacancy in the trial court.
4.
Hence, we are not inclined to grant bail to the petitioner at this stage.
5.
Accordingly, the prayer for bail is rejected. 6.
We request the trial court to conclude the trial at an early date.
7.
We observe upon the judicial officer joining the trial court prompt schedule of dates for examination of the witnesses may be fixed and trial be concluded within six months from the next schedule so fixed without granting unnecessary adjournments to either of the parties.
8.
Parties shall communicate this order to the trial court for necessary compliance.
