The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioner is the sole defendant of Title Suit No. 312 of 2021 pending before the 3rd Court of learned Civil Judge (Senior Division), Howrah. The petitioner is complaining delay in disposal of an application under Order XXXIX Rules 1 & 2 of the Code of Civil Procedure.

The said application is pending since 2021;

besides, the petitioner is suffering an ad interim order of injunction. An application for injunction by its nature demands expeditious disposal.

The learned trial Judge is therefore requested to make all endeavour to dispose of the said application as expeditiously as possible in accordance with law, if the same is otherwise

ready for such disposal, and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 2958 of 2024 is thus disposed of without any order as to costs.
