...for the petitioner This application under Article of the Constitution of India is at the instance of the developer challenging the order being No. 29 dated July 7, 2025 passed by the learned State Consumer Disputes Redressal Commission, West Bengal in SC/19/RA/15/2025 arising out of SC/19/CC/687/2018.

By judgment and order dated April 11, 2025 paased by the State Consumer Disputes Redressal Commission, the Consumer Complaint No.

SC/19/CC/687/2018 was allowed in part on contest with cost. The petitioner filed an application for review of the said judgment and order which also stood dismissed by an order dated July 7, 2025.

Since the review application stood dismissed, the petitioner has to challenge the order passed in the complaint case. An appeal lies against the judgment passed in the complaint case under the provisions of relevant statute.

In view thereof, this Court is not inclined to interfere with the order impugned in this Civil Revision Application.

Faced with such situation, the learned advocate appearing for the petitioner prays for leave to withdraw this Civil revision application with liberty to approach the appropriate forum in accordance with law.

In the light of the above submissions, C.O. No. 3181 of 2025 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law.

Learned advocate on record of the petitioner shall be permitted to take back the certified copy of the impugned order by replacing it with a photostat copy thereof.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
