Learned Advocate appearing for the petitioner submits that the petitioner was not named in the first information report. The police however raided the residence of the petitioner. The petitioner was falsely implicated. Learned Advocate appearing for the State submits that the petitioner was a driver of the truck which was loaded with the stolen materials. The petitioner fled away the spot with the vehicle. He refers to the statement recorded under Section 161 of the Code of Criminal Procedure in this context. Police are yet to submit charge sheet as the investigations are yet to be concluded. Considering the gravity of the offence and the complicity of the petitioner therein and considering the statement recorded under Section 161 of the Code of Criminal Procedure, we are unable to grant anticipatory bail to the petitioner.

CRM 8941 of 2021 is rejected.
