A direction to secure expeditious disposal of Ejectment Suit No. 570 of 2016 pending before the learned Judge, 6th Bench, Small Causes Court, Calcutta, is the ultimate relief sought for in this case. Admittedly, petitioner is the plaintiff, seeking eviction of opposite parties from the subject premises. It is contended by the petitioner that after a long persuasion, and subsequent to the intervention of this Court, the 7(2) application has already been disposed of with much delay.

The only contention thus expressed by the petitioner is that the Ejectment Suit is getting delayed for the adjournment being granted on the prayer of the opposite parties.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.

Service upon the opposite parties is thus dispensed with.

Accordingly, learned Judge, 6th Bench, Small Causes Court, Calcutta in Ejecement Suit No. 570 of 2016 is requested to ensure expeditious disposal of Ejectment Suit referred hereinabove, after causing disposal of the interlocutory applications, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, the year of institution of Ejectment Suit may be taken into account, and the suit may be disposed of expeditiously as possible, preferably before the end of Puja vacation of the Court below for the year 2023. Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
