Petitioner has prayed for cancellation of bail of two acused persons namely Krishna Kanta Paul and Debdas Nath. Report so submitted by the State reflects that the chargeheet has also been submitted but Mr. Hossain, learned advocate appearing for the State has submitted that there may be requirement of signatures of accused nos. 2 & 3 for proper administration of justice.

Having considered that the subject matter of challenge relate to a bail which was granted in the month of May, 2023 i.e., almost 11 months have passed and there is no allegation that the opposite party nos. 2 and 3 has misused the liberty, I direct that the opposite party nos. 2 and 3 should make themselves available as and when called for by the Investigating Officer and be physically present in court on each and every date so fixed.

If an application is taken out by the Investigating Agency for assessing the

signature of any person then in that case if the opposite party nos. 2 and 3 named above are required they are directed to cooperate and comply with the order of the court.

With the aforesaid observations, the present application for cancellation of bail being CRM (SB) 172 of 2023 is disposed of. Pending applications, if any, are disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
