The petitioner participated in the preliminary examination of the 1st State Level Selection Test, 2010 conducted by the West Bengal Madrasah Service Commission, the respondent no.5 herein (in short the Commission) for appointment in the post of Group-D staff at different Madrasahs of the State.

The petitioner cleared the said preliminary examination and had also participated in the written examination conducted by the Commission, he is expecting appointment.

Mr. Mukherjee, leaned advocate for the Commission submits that due to allegation of manipulation, the Commission has struck down the written examination in which the petitioner

had participated, and is preparing list of eligible candidates on the basis of the result of the preliminary screening test.

The Commission is directed to communicate the result of the petitioner in the said screening test within a period of three weeks from the date of communication of this order.

In the event the petitioner is found eligible, he shall be allowed to participate in the written examination.

WPA 20170 of 2023 is disposed of with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations made in the said writ petition are deemed to have been denied by the respondents. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
