1. This is an application under Section 528 read with Section 442 of BNSS, 2023 filed by the petitioner for quashing of the entire proceeding of GR Case No.468 of 2025 arising out of Adra Police Station Case No.54 of 2025 dated 14.06.2025 which was initially started under Section 281/125(a)/106 of BNS, 2023 and subsequently Section 106 of BNS has been added and the same is pending before the learned Additional Chief Judicial Magistrate at Raghunathpur, Purulia.

It is submitted by the learned advocate for the petitioner that on the basis of a complaint lodged by the present opposite party no.2 the number of vehicle that has been alleged to have been involved the petitioner is the owner of the same. It is the specific contention that the vehicle was not involved with such accident. That apart, in a reply to the notice served upon him it was specifically mentioned that if CCTV footage is retrieved it will be detected that the vehicle was not involved therein. Accordingly, he has filed
this revisional application for quashing. The petitioner further prays for an order of protection till the matter is heard by not taking any coercive action by the investigating agency till the revisional application is disposed of.
3. Heard the submission and perused the record and content of the FIR.
4. It is the specific case of the petitioner that his vehicle number is WB44C9963 and admittedly, the petitioner is the owner of the same, which is an undisputed fact. That apart, subsequently the injured succumbed to injury and as a result Section 106 BNS has been added. Investigation of the case is going on. Even if the reply is to be considered the investigating authority must investigate the same and arrive at a logical conclusion.
5. In view of the above facts and circumstances, this Court is of the view that this revisional application is filed at a premature stage and it is not a fit case for admission. Accordingly, this criminal revisional application stands dismissed being not admitted.
6. Urgent Photostat certified copy of this order, if applied for be delivered to the learned advocates for the parties, upon compliance of all formalities.
