Re: An application under Sections 482 read with Section 483 of the Code of Criminal Procedure.

Mr. Dipta Dipak Banerjee - For the Petitioner Ms. Anasuya Sinha Ms. Mayukhi Mitra - For the State Report submitted by the Officer-in-Charge of Magrahat Police Station is kept with the record.

The report reflects that the accused has surrendered before the learned Metropolitan Magistrate, 13th Court, Calcutta in connection with Posta Police Station Case No. 153/2016. The next date, as submitted by learned advocate appearing for the petitioner, is fixed on 17th January, 2024. Learned trial Court is directed to supply copies on the said date and within a fortnight thereafter proceed for consideration of the charges. If the learned trial Court feels that the charges are such that trial is warranted, in that case learned trial Court would fix at least one date in a month so that the trial can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties. The learned Public Prosecutor representing the State would produce documents,

exhibits and other materials required on the date fixed for examination of the witnesses to be examined. All stakeholders are directed to cooperate with the learned trial Court to conclude the trial at the earliest.

With the aforesaid observation, CRR 3115 of 2023 is disposed of.

All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. (Tirthankar Ghosh, J.)
