1. The petitioner has filed the present application praying for a direction upon the respondent No. 3 for issuance of Legal Heir Certificate. The petitioner says that the petitioner has applied before the District Collector, Paschim Barchaman on 5th April, 2024 for issuance of the Legal Heir Certificate of the deceased Tapati Mukherjee (Banerjee) who died on 5th June, 2022. But in spite of receipt of the representation submitted by the petitioner, the authorities have not issued the Legal Heir Certificate and the representation filed by the petitioner is pending before the District Collector.

2. Considering the submission made by the learned counsel for the petitioner and after perusing the record, this Court finds that the petitioner has made a representation to the District Collector, Paschim Bardhaman on 5th April, 2024 for issuance of Legal

Heir Certificate upon the death of his wife, namely, Tapati Mukherjee (Banerjee), who died on 5th June, 2022. The same is still pending before the District Collector, Paschim Bardhaman.

3. In view of the above, the writ petition is disposed of by directing the District Collector, Paschim Bardhaman to dispose of the representation filed by the petitioner dated 5th April, 2024 after giving an opportunity of hearing to the petitioner within four weeks from the date of receipt of the order.

4. Accordingly, the writ petition being WPA 20761 of 2024 is disposed of.

5. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
