AAG Mr. Jahar Lal De, Mr. Suman Sengupta, Advocates ... for the State The issue raised in the writ petition is in respect of issuance of fake/duplicate MGNREGA job cards and fraud practice by the private respondents in withdrawing money without getting the work done.

Leaned counsel for the petitioner has pointed out that the petitioner has already filed a detailed representation dated 04.02.2020 before the respondent No.3, District Magistrate, Birbhum but on the said representation no action has been taken and the petitioner in fact has been threatened by some persons thereafter. He has prayed for a direction to the respondent No.3 to decide the pending representation by passing a reasoned order.

Learned counsel for the State has no objection to the same.

Hence, we dispose of the present writ petition without expressing any opinion to the merit of the matter

WPA (P) 365 of 2021 by directing the respondent No.3 to duly consider the petitioner's representation in accordance with law and pass a reasoned order thereupon after conducting the enquiry, if required, as expeditiously as possible preferably within 3 months from the date of receipt of the copy of this order.

The petition is accordingly disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
