Mr. Mohammad Mahmud, Ms. Pinki Das ...for the petitioner Mr. Sujit Sankar Koley ...for the WBSEDCL Affidavit-in-reply filed in court today be kept on record.

The limited dispute raised in the present writ petition is that, according to the petitioner, although this court had previously directed the petitioner to pay LPSC (Late Payment Surcharge), the LPSC assessed by the WBSEDCL was arbitrary and illegal.

However, it is well-settled that in the case of any billing dispute, the concerned Grievance Redressal Officer (GRO) has to be approached by the person raising such dispute.

Accordingly, there is no scope of interference in the present writ petition, particularly, in view of the previous direction of this court directing the petitioner to deposit LPSC.

Hence, W.P.A. 20528of 2022 is dismissed without any order as to costs.

However, this order shall not preclude the petitioner, if he is aggrieved by the quantum of LPSC assessed by the WBSEDCL, from approaching the concerned Grievance Redressal Officer for appropriate reliefs.

If so approached, the concerned Grievance Redressal Officer shall decide such dispute in accordance with law, as expeditiously as possible. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
