By the present writ petition, the petitioner seeks direction upon the respondent nos.2 to 4, to consider the representation of the petitioner for transfer on surplus, medical and distance grounds from his present place of posting i.e., Mahipur FP School under Raiganj North Circle, district Uttar Dinajpur to any school nearby to his residence under Nadia District Primary School Council.

The petitioner contends that he is an Assistant Teacher at Mahipur FP School under Raiganj North Circle. The petitioner joined the school on 5th April, 2022. The petitioner's wife is suffering

from serous gynaecological problems and his son is affected by dermoid cyst. The petitioner has to travel 300 kilometres everyday to attend his work place. The petitioner made representation before the respondent authorities on 15th January, 2025 seeking transfer. However, the same is pending with the authority. Hence, this writ petition. 4.

Mr. Ratul Biswas, learned advocate, for the West Bengal Board of Primary Education submits that the matter be relegated to the appropriate authority to take a decision on the matter of transfer of the petitioner in accordance with law. 5.

In view of the above, the respondent no.4, the Secretary, West Bengal Board of Primary Education, is directed to consider and dispose of the representation of the petitioner dated 15th January, 2025, in accordance with law, within a period of six weeks from the date of communication of this order.

The petitioner is directed to communicate this order to the respondent no.4, the Secretary, West Bengal Board of Primary Education.

With the above direction, writ petition, being WPA 20264 of 2025, stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

Connected application, if any, stands disposed of.

10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

11. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
