Supplementary affidavit filed on behalf of the petitioner disclosing the address of the present petitioner be kept with the record.

Mr. Datta Gupta, learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with M.L. Case No. 08 of 2019 and subsequently warrant of arrest has been issued against him in connection with the said case by the learned Special (CBI) Court No.1, Calcutta.

As the petitioner was not arrested and anticipatory bail was granted (as submitted by the learned advocate for the petitioner) in connection with the instant case and as Mr. Datta Gupta, learned advocate for the petitioner submits that the petitioner would adhere to the conditions imposed by the learned trial court and will not create any impediment for progress of the trial and would appear with a prayer for regular bail before the learned Special Court, I direct that in case the petitioner surrenders by 10.03.2024 and prays for bail, the learned trial court would in such circumstances consider his bail and allow him to furnish bond as was

directed in the order dated 09.04.2021 passed in CRM 707 of 2021 subject to condition that the petitioner would meet the Investigating Officer of the case and/or any authorised officer of the Enforcement Directorate once in every ten days either at its office at Calcutta or at its office at Delhi for a period of six months.

If the petitioner fails to appear/surrender by 10.03.2024, the earlier order passed by the learned Special Court would revive and the learned Special Court would at that stage consider to exhaust the provisions of Section 82 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 2687 of 2021 along with CRAN 1 of 2023 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
