Report submitted by Mr. Hossain, learned advocate appearing for the State be kept with the record. The present case was instituted in the year 2011 being Islampur P.S. Case No.830 of 2011 dated 09.12.2011. The report is enclosed with an affidavit along with the statement recorded of the lady, namely, Sangita Sengupta (Ghosh). Learned advocate for the petitioner as well as private opposite party no.2 is present.

Having regard to the contentions advanced by the petitioner that she do not intend to pursue with the present litigation, I am of the view that further continuance of the proceedings which was simply under Section 498A/406/34 of the Indian Penal Code and arose out of matrimonial discord is

unwarranted.

Accordingly, all further proceedings of Islampur Police Station Case No.830 of 2011 dated 09.12.2011 corresponding to G.R. No.2450 of 2011 pending before the learned ACJM, Islampur, Uttar Dinajpur be hereby quashed.

Consequently, CRR 3120 of 2023 is allowed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
