Petitioner has prayed for quashing of the proceeding. Uncontroverted allegations in the impugned charge sheet show the accused persons had entered into a conspiracy and defrauded unsuspecting unemployed youth on the false promise of giving employment with the Ministry of Road Transport and Highways, Government of India. Petitioner is one of the conspirators who had induced the victims to make payment on false promise of getting employment. 2.

Uncontroverted allegations disclose ingredients of the offence of cheating and criminal breach of trust. There is no illegality or jurisdictional error in the impugned charge sheet. It is open to the petitioner to canvass his defence at the appropriate stage of the proceeding in accordance with law, if so advised.
