Petitioner is the husband of opposite party-wife. He prays for transfer of the maintenance proceeding from the file of the Judicial Magistrate, 4th Court, Serampore, Hooghly to the Court of the learned Additional Chief Judicial Magistrate, Burdwan, Purba Burdwan.

I have considered the materials on record. It is contended the divorce proceeding is pending at Burdwan Court. Maintenance proceedings are for ameliorating the immediate economic needs of the wife. Mere pendency of the divorce proceeding at Burdwan is no ground for transfer of the maintenance case. No other circumstance necessitating transfer of the maintenance proceeding from Serampore Court where opposite party no.2-wife is residing is made out. 3.

Under such circumstances, I am not inclined to transfer the proceedings from the file of the Judicial Magistrate, 4th Court, Serampore, Hooghly.

The application is, thus, dismissed.
