Ajoy Kr. Rai And ANR. v. State Of West Bengal And ORS.
07.02.2023.
Court No.13 Item No. 341 ap W.P.A. No. 21231 of 2021 Sri Ajoy Kumar Rai & Anr.
Versus
The State of West Bengal & Ors.
Mr. Mayukh Nandi, Mr. Mrinal Kanti Kundu.
..For the petitioner.
The petitioner complains of alleged inaction on the part of Sinthi Police Station.
A complaint was lodged on 10th March, 2021 against one Noor Khan, who appears to be demanding a sum of Rs.1 lac from the petitioner.
Counsel for the petitioner submits that his client borrowed a sum of Rs.1 lac from Noor Khan and repaid the same. It is further submitted that Noor Khan is stated to have obtained the signature of the petitioner in a document indicating that a further sum of Rs.1 lac has been paid to him. Threats, intimidation and abusive languages ensued against the petitioner thereafter.
Sinthi Police Station has enquired into the matter and has found initially the said Noor Khan was responding but subsequently he was not found at his residence at Cossipore Road. G.D. entries have been made. It is unlikely that the said Noor Khan may have threatened the petitioner after March, 2021.
Be that as it may, the civil disputes between the petitioner, the private respondents and the said Noor Khan may be agitated before the civil forum in accordance with law.
In the event of any further threat from the private respondents, the petitioner may lodge a formal complaint with the Sinthi Police Station, who may take steps in accordance with law.
The report of Officer-in-charge, Sinthi Police Station dated 3rd February, 2023 be taken on record. With the aforesaid directions, the instant writ petition shall stand disposed of.
There will be no order as to costs.
All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
