Learned counsel appearing for the petitioner submits as follows. The petitioner is a trust. It wants to open a nursing college in the State of West Bengal. It applied for running a course of G.N.M. (General Nursing and Midwifery) in the said nursing college with the concerned Health Directorate. First, the Health Directorate needs to make an inspection and give an Essentiality Certificate. After this, the West Bengal Nursing Council would do necessary inspection and grant final permission. Although applications were made in this regard, the Health Directorate has not taken any steps.
Learned senior counsel representing the State submits, upon instructions, that steps are being taken by the Health Directorate in this regard.
The Indian Nursing Council is represented.
It appears that the petitioner has made application for permission to open a nursing college.
In the event necessary inspection has not yet been done by the Health Directorate, let the respondent no. 3 conduct such inspection within three weeks from the date of communication of this order and take a final decision on issuance of Essentiality Certificate within a week thereafter. The result of such communication shall then be intimated forthwith to the petitioner and to the West Bengal Nursing Council for further steps.
With these observations, the writ petition is disposed of. However, the merits of the case have not been gone into. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon completion of necessary formalities.
