State of West Bengal Mr. Amrit Sinha ...for the petitioners This is an application where petitioner has sought for expeditious disposal of Complaint Case No.815 of 2025 pending before the learned Judicial Magistrate, Barasat.

It is submitted on behalf of the petitioner that the petitioner filed an application under Section 175(3) of the BNSS, 2023 with a prayer for a direction upon jurisdictional police station to start investigation treating the petitioner of complaint as FIR. Such petition was filed before the concerned Magistrate on 6th May, 2025. He further submits that even after expiry of about 5 months, said application has not yet been disposed of by the Court below. Accordingly, petitioner has prayed for a direction upon the Court below for expeditious disposal of the said application.

Having heard learned Counsel appearing on behalf of the petitioner and that the prayer made therein is innocuous serving a copy of application upon opposite party is dispensed with. Having heard learned Counsel for the petitioner and that the prayer made on behalf of the petitioner is justified and if allowed will not cause prejudice to any of the parties, the instant application being CRR 3808 of 2025 is hereby disposed of with a direction upon the learned Chief Judicial Magistrate, Barasat to dispose of petitioner's application

under Section 175(3) of the BNSS, 2023 within a period of one month from the date of this order.
