1. The petitioners in the instant case are the villagers of Sherpur Gram Panchayat, Police Station - Usthi, District - South 24 Parganas.

2. Main grievance of the petitioners are that they are obstructed by the private respondents to enter the temple of "Shree Shree Panchanan Thakur" for performing daily pujas.

3. An illegal construction has been erected by the private respondents facing the land of the temple for which the villagers are obstructed to enter the

temple through the private passage of the private respondents.

4. The petitioners are the affected villagers. They made written complaint to the respondent authorities. Till date such representation has not been considered by the respondent authorities.

5. Considering the above, the respondent no.7 is directed to consider the grievance of the petitioners within two weeks from the date of communication of this order and pass a reasoned order in accordance with law by affording an opportunity of hearing to all the interested parties and communicate the same thereafter to the petitioners and also direct the private respondents to earmark the particular space for the egress and ingress of the villagers for entering into the temple for performing their daily pujas.

6. It is made clear that if the construction is found to be illegal, the concerned Prodhan shall take necessary steps in accordance with law.

7. Needless to mention, that the private respondents have already given an undertaking that they will not obstruct the villagers from entering the temple through the proposed passage.

8. Accordingly, this PIL stands disposed of without expressing any opinion on the merits of the case.
