The learned advocate for the petitioner is present in Court today. His personal appearance is noted and dispensed with. The report filed by the Inspector-in-Charge, Taldangra Police Station District Bakura dated 14.05.2023 through the learned advocate for the State stating the facts and circumstances of the Taldangra Police Station Case No. 36/04 dated 22.09.2014 under Section 135(1)( c ) of the Electricity Act, 2003 read with Section 379 of the Indian Penal Code pending before the learned Sub-Divisional Judicial Magistrate, Khatra. Let the said report be kept on record. The learned advocate for the petitioner submits a written instruction that his client does not wish to proceed with the matter. A written instruction dated 02.09.2023 submitted before the court to that effect be kept on record.

Under the facts and circumstances, the instant criminal revesional application is dismissed for non-prosecution.

The petitioner is at liberty to agitate his grievance before the learned trial court.
