Advocate for the petitioner has filed a Supplementary Affidavit enclosing an application of M. Execution Case No. 369 of 2022, which was filed in connection with M. Case No. 792 of 2021. The prayer in the said application for execution case was for the issues relating to an amount of Rs.80,640/-.

Ld. advocate for the petitioner submits that the petitioner happens to be an army personnel and warrant of arrest has been issued against him.

In view of the prayer so advanced by the petitioner, I direct that in two equal instalments, the whole of the arrears relating to Rs.80,640/- be cleared by 31st of December, 2023. The first of such instalment be paid by 31st of October, 2023. Immediately on receipt of Rs.40,640/-, the ld. Magistrate will keep the warrant of arrest, so issued,

suspended till 31st of December, 2023. Immediately on payment of the subsequent amount i.e. Rs.40,000/-, the ld. Magistrate will recall the warrant of arrest. With the aforesaid observations, CRR 3124 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
