This is an application for quashing of a proceeding in G.R. Case No. 1243 of 2016 pending before the learned Metropolitan Magistrate, 4th Court, Calcutta. Learned counsel appearing on behalf of the petitioners submits as follows. During the pendency of the proceeding, a compromise and settlement was arrived at between the private respondents of all disputes that had led to the impugned proceeding. The sum allegedly due to the defacto complainant was paid. In view of the compromise and settlement the impugned proceeding may be quashed. Learned counsel appearing on behalf of the defacto complainant/victim submits as follows. The compromise and
settlement has been duly arrived at between the accused petitioners and the defacto complainant/opposite party of all disputes that had led to the registration of the First Information Report. The defacto complainant has got back his dues and he does not want to proceed with the case any further.
Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. The disputes appear to be private in nature between two private entities. The State would not come in the way if the private parties enter into a settlement and compromise.
I have heard the submissions of the learned counsels appearing on behalf of the petitioners, the defacto complaint and the State and have perused the revision petition, the point compromise petition and the case diary. It appears that the disputes that had led to be initiation of the impugned proceeding have been settled between the private parties.
Dispute between the parties appear to be of private nature.
In view of the above and in the interest of justice, I quash the impugned proceeding on the ground of compromise and settlement.
With these observations, the revisional application and the connection CRAN 1 of 2021 are disposed of .
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
