Petitioner approached this Court with prayers for preservation of call detail records of a particular mobile number which belongs to her. Petitioner is an accused in connection with Sonarpur P.S. Case No.579 of 2025. The said case was registered in respect of a matrimonial dispute having taken place.

State has submitted a report. Report reflects that on conclusion of investigation, charge-sheet has been submitted before the jurisdictional court. Learned advocate for the respondent no.5 submits that for collection of evidence a plea of alibi is

attempted to be created and for that purpose the application has been preferred before this Court. Be that as it may, since the jurisdictional court is in seisin of Sonarpur P.S. Case No.579 of 2025, petitioner would, in case the service provider do not provide the details, approach the court and if any application is taken out, the learned court within a period of 60 days would dispose of the said application after notifying all the parties.

With the aforesaid observations, WPA 20349 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
