Mr. Hemanta Kumar Das Mr. Nepesh Majhi ... ... for the petitioners Mr. Jahar Lal De Mr. Rudranil Dey ... for the State Mr. Goutam Banerjee ... ... for the respondent nos.7 to 9 In this public interest petition the grievance raised by the petitioners is that the respondent Pradhan of Harua Gram Panchayat has mismanaged and embezzled the government fund which was sanctioned for different public works.

Learned counsel for the petitioners has pointed out that an enquiry in this regard was conducted and the enquiry report dated 19.03.2020 is on record as Annexure P-2 and thereafter the respondent no.6 had issued the notice dated 14.07.2022 to the respondent no.7 to deposit the said amount relating to unauthorized payment. The grievance of the petitioners is that thereafter no action has been taken in this regard. Learned counsel for the State fairly submits that there is no objection in taking appropriate action and that the entire issue should be looked into by the respondent no.3, District Magistrate, Murshidabad within a time bound period.

Learned counsel for the respondent nos.7 to 9 has also submitted that they are entitled to opportunity of hearing in that process.

Hence, we dispose of the present petition by directing the respondent no.3 to take appropriate action in compliance of the enquiry report dated 19.03.2020 and also in furtherance of the notice dated 14.07.2022 after giving an opportunity of hearing to all the concerned parties.

Let this exercise be completed within a period of four months from the date of receipt of a copy of this order.
