The instant application under Article 227 of the Constitution of India is at the instance of the defendant in a suit for eviction of trespassers, and is directed against the Order No. 08, dated May 10, 2024 passed by the 2nd Court of learned Civil Judge, (Junior Division) at Chandernagore, District - Hooghly, in the said suit being Title Suit No. 204 of 2023.

The learned Trial Judge by the order impugned has dismissed an application filed by the petitioner for amendment of the written statement to bring on record the names of some other persons as defendants in the suit alleging that the father of the said persons was the original tenant in respect of the suit property.

The amendment sought for is completely irrelevant to the scope of the suit, this Court therefore does not find any reason to interfere with the order impugned; C.O. 2968 of 2024 is dismissed without any order as to costs.
