The petitioner participated in the selection process for filling up the vacancies for the Post of Assistant Teacher in upper primary schools in relation to the First State Level Selection Test, 2016. In terms of the direction passed by a co-ordinate Bench of this Court in WPA No. 10789 of 2021, the Commission afforded opportunity to the petitioner to ventilate her grievance in respect of the said selection process but the petitioner missed the date fixed for such hearing.
The petitioner is praying a further opportunity of hearing on the ground that due to her illness, she could not appear before the Commission on August 27, 2021 i.e. the schedule date.
Dr. Patra, learned counsel for the Commission submits that after undertaking a mammoth task of
providing personal hearing to huge number of candidates, the grievance hearing was completed by the month of December, 2021, at this stage, the said process cannot be re-initiated for the petitioner. He further submits that the entire selection process is being monitored by the Hon'ble Division Bench taking the appeal MAT 638 of 2021 (Rajib Brahma & Ors. vs. State of West Bengal & Ors.) therefore, it is not open for the Commission to resurrect the grievance hearing for the petitioner. The Hon'ble Division Bench since is monitoring the entire selection process, propriety demands that the writ petition be placed before the Hon'ble Division Bench for consideration of the prayer of the petitioner.
Accordingly, records of the instant writ petition be placed before the said Hon'ble Division Bench in connection with the aforementioned appeal.
