(VIA VIDEO CONFERENCE) Mr. Ranjan Bachawat Mr. Satyaki Mukherjee Mr. Suryanu Sengupta ..for the petitioner Mr. Ansar Mondal ...for the State It is contended by the learned counsel appearing on behalf of the petitioner that the petitioner acquired title and possession in respect of the land in question by virtue of a deed of gift dated July 07, 1990 executed by the State of West Bengal in favour of the petitioner. After expiry of the term of 10 years of prohibition for transfer or alienation of the property, the petitioner approached the concerned authority for mutating his name as 'Raiyat' in respect of the land. The representation in this regard submitted by the petitioner on January 04, 2020 is yet to be disposed of. The petitioner prays for direction upon the concerned authority to consider the said representation at the earliest.

Learned counsel appearing for the State-respondents submits that the concerned authority be directed to consider the representation of the petitioner within a stipulated period of time.

Upon consideration of the submission made by the learned counsels appearing on behalf of the parties and the material on record, the writ petition is disposed of directing the respondent no. 4 to consider and dispose of the representation filed by the petitioner on January 04, 2020 within a period of two months from the date of communication of this order, after giving reasonable opportunity of hearing to all the affected parties including the petitioner, in accordance with law.

The decision taken by the respondent no. 4 shall be communicated to parties whom he has heard within one week thereafter.

With the above observations and directions this writ petition being WPA No. 21283 of 2021 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
