Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. The incident is a post poll violence. However, Central Bureau of Investigation did not investigating into the present police case. he submits that, five persons are on anticipatory bail.

Learned advocate appearing for the State draws the attention of the Court to the statement of two injured eye witnesses recorded under Section 164 of the Code of Criminal Procedure (Cr.P.C.) implicating the petitioner in the assault of grievous hurt. The petitioner was part of the mob, which murdered one of the victim.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials available in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 8975 of 2021 is dismissed.
