.......Petitioner Ms.Reshmi Ghosh Ms. Parna Mukherjee ...for the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of A.C. 2361 of 2022 pending before the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the matter.

Learned counsel for the petitioner submits that the matter is pending since 2022 and though warrant of arrest has been issued against the opposite party/accused, the same is yet to be executed despite several opportunities being granted by the learned Trial Court.

Upon consideration of the submission made on behalf of the petitioner as well as the material on record, this Court directs the learned Trial Court to exhaust all procedure for securing the attendance of the opposite party/ accused before the learned Court and dispose of the case as expeditiously as possible without

granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR No. 3509 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
