Banerjee) Mr. Chittaranjan Panda Ms. Shipra Santra ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Sr. Division), Sealdah to dispose of Title Suit No. 60 of 2013 expeditiously.

Learned advocate appearing for the petitioner submits that an application under Section 10 of the Civil Procedure Code is still pending. He further submits that the suit is pending from the year 2013. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 3186 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Division), Sealdah to take up the application under Section 10 of the Civil Procedure Code on the next date fixed, if the same is otherwise ready for haring and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory application, the learned Civil Judge (Sr. Division), Sealdah shall make an endeavour to dispose of Title Suit No. 60 of 2013 as expeditiously as possible, preferably by the end of the year 2026, without granting any unnecessary adjournment to either of the parties. This order has been passed considering the fact the suit is pending since the year 2013.
