Mr. Subroto Roy ... for the State Learned Counsel appearing for the petitioner submits he is in custody for more than three months. It is also submitted that there is no material connecting him with the crime. He, accordingly, prays for bail.

Learned Public Prosecutor opposes prayer for bail and submits witnesses identified the petitioner during test identification parade as one of the miscreants who entered premises where robbery and murder were committed. Butt of the knife which was used to commit the murder was recovered on the statement of the petitioner. Co-accused made a judicial confession implicating himself as well as the petitioner in the alleged offence.

We have considered materials on record. Keeping in mind the aforesaid incriminating materials and gravity of the offence which relates to robbery and murder of two innocent victims, we are not inclined to grant bail to the petitioner.
