The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Bishnupur P.S. Case No. 258 of 2019 dated 11.04.2019 corresponding to POCSO (Special) Case No.66 of 2019 under Section 6 of the POCSO Act.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. Prima facie, there are strong incriminating materials on record against the petitioner. The petitioner's prayer for bail was earlier rejected by a co-ordinate Bench of this Court on 8th of December, 2021 in C.R.M. 8083 of 2021. Let the copy of the order dated 8th December, 2021, as produced before this Court, be kept on record.

We do not find any substantial change in the circumstances subsequent to rejection of the petitioner's earlier application for bail on 8th December, 2021.

In view thereof, we are not inclined to exercise any discretion in favour of the petitioner. Accordingly, his prayer for bail is refused at this stage.
