Petitioner is aggrieved by the fact that no steps have been taken by the police authorities in connection with Garhbeta Police Station Case No. 20 of 2025 dated 20.01.2025. State has submitted a report. Report reflects that the police authorities, on completion of investigation, have submitted a final report discharging all the accused persons and the opinion of the Investigating Officer is that on investigation, the dispute appears to be civil in nature.

Having considered that a criminal case was registered for investigation and a final report has been submitted on or about 12.08.2025 before the jurisdictional Magistrate, I am of the view that a notice must be sent to the de-facto complainant of the case to address his grievance.

Accordingly, the petitioner is directed to ventilate all his grievances by way of an application under Section 173 of the Code of Criminal Procedure (Section 193 of the Bharatiya Nagarik Suraksha Sanhita, 2023). Learned Magistrate would, in

case such an application is preferred, dispose of the same within a period of sixty days from the date of filing of such application. With the aforesaid observations, WPA 20370 of 2025 is disposed of.

Report submitted by the learned advocate appearing for the State be also kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
