Report submitted by the State is taken on record. It is submitted on behalf of the 12th respondent that the facebook posts of the petitioner have been permanently removed from the social media platform and details thereof provided to the State authorities. Learned counsel further submits that this respondent has a comprehensive mechanism to remove posts from the account permanently upon receipt of necessary direction.
The petitioner is aggrieved by the fact that the State authority is still continuing with preliminary enquiry and has not lodged FIR despite expiry of the statutory period of time.
On the contrary, learned counsel for the State submits that the State was waiting for data from the 12th respondent and has asked for the CDRs and SDRs of the
suspects in order to take steps against the alleged miscreants. It is also submitted that the entire exercise started after the 12th respondent was added as a party respondent to the writ petition.
In view of the fact that the complaint lodged by the petitioner is pending since long, the State authorities are directed to take necessary steps in accordance with law as expeditiously as possible.
The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
